EMTALA states that if a patient presents to a hospital with an emergency department for emergency care, the patient must receive a medical screening exam by a qualified provider and stabilization of any emergency medical condition, and the hospital must provide transfer or acceptance of transfer of patients as appropriate. EMTALA applies to hospitals with dedicated emergency departments (which can be defined as providing at least 1/3 of its visits for treatment of emergency medical conditions; EDs can be on or off the main hospital campus). The patient is defined as having come to the hospital/ED once they are within 250 yards of the hospital campus.
